Warranty - Mattress


10-year limited warranty (Mattress, Mattress Advanced)

Normal Wear

We pride ourselves in designing the most innovative mattress on the market to improve your sleep. Our unique airfiber® material will provide the firm support you need but please be aware that some softening due to conforming to body type will occur over the course of time and this may feel different to each customer. A proper bed frame that prevents sagging and sufficiently supports the collective weight of the Mattress and any foundation is necessary. 

Our 10-year Limited Mattress Warranty applies to the following Defects: 

  1. Deterioration causing the Mattress to have a visible indentation greater than one (1) inch that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation. 
  2. Any physical flaw in the Mattress that causes the airfiber® material to split or crack despite normal usage and proper handling. 
  3. Any manufacturing defect, scratch, improper knitting and stains in the zipper assembly of the Mattress Cover. 

This Limited Mattress Warranty does not cover the following: 

  1. A normal increase in softness of the airfiber pressure-relieving material which does not affect the pressure-relieving qualities of the Mattress. 
  2. Comfort preference - if you utilize the Mattress outside of normal wear due to comfort preference
  3. Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears or stains; provided, that the defect is caused by such abuse or damage. 
  4. Deterioration caused by Force Majeure (unforeseeable circumstances)
  5. Replacement of any non-defective pieces in the airweave sleep system (for example, if you purchase a mattress with multiple components and only one component is defective, then we will only replace the defective component).  
  6. Any Mattress sold by resellers who are not authorized retailers. If you are unsure if the retailer you purchased an airweave Mattress from is authorized, please contact us. 
  7. Mattresses sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Mattress is not “new” or of “first quality”, or has previously been purchased or used by another consumer. 
  8. Any Mattress outside of the contiguous 48 states
  9. Any claim made outside of the warranty period

Product Replacement Terms 

In the event of a Defect, airweave’s sole and exclusive liability and your sole remedy under this 10-Year Limited Mattress Warranty will be, at airweave’s option, to provide a repaired or replacement Mattress, Mattress Cover, or a store credit. Replacements may be provided in a color/style different from what was originally purchased. A store credit may be used for an upgrade, replacement is temporarily out of stock, or if the replacement has been discontinued. 

If a purchaser elects to upgrade to a more expensive product, purchaser may do so with the provided store credit and by paying the difference. In the event of an upgrade as described in this paragraph, a new warranty will be provided for the upgraded product. 

Replaced or repaired Mattresses that are not upgraded products are subject to the same Limited Warranty as the original Mattress. For example, if your obtain a replaced or repaired Mattress that is the same style and price as the original Mattress, then the warranty term of the replaced or repaired Mattress begins from the date of purchase of the original Mattress. 

Your Responsibilities

Our Quality Assurance team who assess each warranty claim is located in Japan and so we rely on you the customer to provide us with the necessary details to determine if the product is covered under warranty or not. In order to take advantage of the remedy provided under this agreement, you must:

  1. Initiate the claim by emailing us at support@airweave.us with the date of purchase, description of the alleged defect, and the following photos:
    1. A photo or photos of the Mattress showing proof of defect 
      1. For a claim of indentation over 1 inch, customer should send a photo like so 
    1. A photo or photos of the surface of the bed frame with the Mattress on top 
    2. A photo or photos of the surface of the bed frame without the Mattress on top
    3. A photo of the front and back of the tag affixed to the Mattress that contains the product Lot Number. 
  1. Should the claim be accepted, you must return the product being replaced or repaired within 30 days of the claim initiation.
  2. Your warranty claims must be made within 30 days of detection of the alleged defect occurring within the warranty period. 
  3. You will not be responsible for shipping costs of your first warranty claim under your customer account or any other customer accounts related by name, address, or billing information. 
  4. You will be responsible for shipping costs of any additional claims made.

EXCEPT AS OTHERWISE EXPRESSLY STATED IN THIS LIMITED WARRANTY, AIRWEAVE DISCLAIMS ANY RESPONSIBILITY FOR LOSSES, EXPENSES, INCONVENIENCES, AND SPECIAL, INDIRECT, SECONDARY, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RESULTING IN ANY MANNER FROM THE PRODUCT. THIS EXPRESS LIMITED WARRANTY IS IN PLACE OF AND EXCLUDES ALL OTHER WARRANTIES INCLUDING THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EXCEPT AS OTHERWISE REQUIRED BY LAW, THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. 

Arbitration

Any dispute, controversy, or claim arising out of or relating in any way to relating to this Limited Warranty hall be governed by and interpreted in accordance with the laws of New York, without regard to principles of conflict of laws. At airweave’s sole election, all disputes must be brought in arbitration in New York City, New York before three (3) arbitrators of the American Arbitration Association (“AAA”). The arbitrators shall be selected by application of the rules of the AAA, or by mutual agreement of the parties, except that such arbitrators shall be an attorney admitted to practice law New York. You and airweave agree that no Arbitrator has authority to award relief in excess of what this agreement provides, award punitive damages or other damages not measured by the prevailing party’s actual damages, or order consolidation or class arbitration.


Warranty - Topper & Futon


3-year Limited Warranty (Top Mattress, Top Mattress Luxe, Top Mattress Classic, Futon)

Our unique airfiber® material will provide the firm support you need but please be aware that some softening due to conforming to body type will occur over the course of time and this may feel different to each customer. When stored in its folded position for extended periods of time, you may also expect to see deterioration at the folds. A proper bed frame that prevents sagging and sufficiently supports the collective weight of the Topper or Futon and any foundation is necessary. 

Our 3-Year Limited Topper & Futon Warranty applies to the following Defects: 

  1. Deterioration causing the Topper or Futon to have a visible indentation greater than one (1) inch that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation. 
  2. Any physical flaw in the Topper or Futon that causes the airfiber® material to split or crack despite normal usage and proper handling.

A proper bed frame that prevents sagging and sufficiently supports the collective weight of the Portable and any foundation is necessary. 

Our 3-Year Limited Topper & Traveler Warranty applies to the following Defects: 

  1. Deterioration causing the Portable or Traveler to have a visible indentation greater than one (1) inch that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation. 
  2. Any physical flaw in the Portable or Traveler that causes the airfiber® material to split or crack despite normal usage and proper handling. 
  3. Any manufacturing defect, scratch, improper knitting and stains in the zipper assembly of the Portable or Traveler. 

This Limited Warranty does not cover the following: 

  1. A normal increase in softness of the airfiber pressure-relieving material which does not affect the pressure-relieving qualities of the Portable or Traveler. 
  2. Comfort preference - if you utilize the Portable or Traveler outside of normal wear due to comfort preference.
  3. Physical abuse or damage to the structure and/or cover material, including but not limited to, improper storing, burns, cuts, tears or stains; provided, that the defect is caused by such abuse or damage. 
  4. Deterioration caused by Force Majeure (unforeseeable circumstances)
  5. Replacement of any non-defective pieces in the airweave sleep system (for example, if you purchase a mattress with multiple components and only one component is defective, then we will only replace the defective component).
